The Emerging Lex Aviatica
It is, by rules of international aviation law, impossible to fly from the US to Japan with a non-US or non-Japanese airline. Why that is the case and how this can be solved with an emerging lex aviatica, is the subject of this article by Brian Havel and Gabriel Sanchez.

Havel and Sanchez identify an emerging normative transition ( that they dub the 'lex aviatica') that tries to displace the treaty-based 'national rule'. In this article they analize how this normative transition could transform the global regulatory order for international aviation, liberating commercial and investment opportunities that will allow the industry that globalized the world to become global itself.
